The prerogatives of the Members of the European Parliament under the light of the case-law of the Court of Justice

Abstract

The aim of this paper is to outline the legal regime of the inviolability and parliamentary immunity of the Members of the European Parliament, with some references to the other prerogatives that make up their legal status and paying special attention to the contributions made by the Court of Justice in this respect. Particularly in recent times, when it has resolved disputes concerning its scope or application. After an historical approach to the issue, addressing the initial regulation of these prerogatives and the different proposals that, unsuccessfully, have been put forward over time to define an autonomous statute for MEPs, the research sets out the problems of the current legal framework, made up of various archaic Community rules and multiple State provisions of particularly complex application. Then, the legal regime of inviolability for speech and votes cast in the exercise of the mandate and immunity from prosecution is analysed. The last one is of particular interest because of recent case law pronouncements on its temporal application and on the delimitation of the competence of the European Parliament about the assessment of possible political motivations in the accusations against its members. The main conclusion to is that the current legal framework in this topic, as configured by the rules and case law, is not adapted to the needs of a parliament with genuine decision-making powers and autonomy from state legislatures, as it creates a situation of asymmetry among the MEPs.
